Abstract

This paper sets out the theory of the nullity of general provisions and their application in case law, analyzing the possibility of a more flexible interpretation in cases where the nullity is determined by an irregularity in the procedure of elaboration of said rules. It also examines the effects of the declaration of nullity of the urban and territorial planning, and especially in relation to the Subregional Territorial Planning of the Western Costa del Sol, recently annulled by the Supreme Court.
