Change of trend in the jurisprudence of the Spanish Supreme Court on digital administration

Comments on several 2021 judgements that make citizens’ compliance with the requirements more flexible or increase the requirements to the Administration regarding electronic relations

Abstract

The generalization of digital administration is leading to a decrease in citizens’ rights, especially when it imposes a duty to use electronic means of communication. Case-law has been quite relentless in enforcing the requirements arising from the electronic relationship. But a number of recent Supreme Court judgements show a change in trend, tending to make citizens’ compliance with the requirements more flexible and to tighten the requirements to be met by the Public Administration.
