Administrative situations in the new Law 5/2023 on Civil Service of Andalusia

Abstract

Law 5/2023 of 7 June on the Civil Service of Andalucía establishes, for the first time, a specific legal regime for the administrative situations of civil servants in this Autonomous Community. This legal regime includes, on the one hand, a development and adaptation of the basic administrative situations to the institutional and administrative system of Andalucía and, on the other hand, the creation of autonomous administrative situations: voluntary leave (of absence) for service in the Andalusian public sector; leave due to incompatibility, leave with reservation of post, voluntary leave with incentives, forced leave and expectation of post. The situation of suspension of functions has its own modality when it is decided due to criminal proceedings or sentence. Finally, the Law includes a special article on the administrative situations of interim civil servants.
