Abstract

The present study aims to understand and explain the “special moment” that the Administrative State, or if it’s preferible, U.S. Administrative Law, is currently experiencing. To this end, we refer to the most authoritative doctrine, which highlights the significant ideological tension between those who justify its particular functioning and its detractors. This issue requires drawing on other legal disciplines that help elucidate the foundation of both positions.

The research gains significance since June 28, 2024, when the United States Supreme Court overturned the Chevron doctrine, established in a 1984 decision that granted federal regulatory agencies broad authority to interpret and enforce statutes within their respective jurisdictions.
