Abstract

Reliance on the capacity of other entities is a right granted to tenderers under Article 75 of Law 9/2017, of November 8, on Public Sector Contracts, the exercise of which is conditioned upon its express declaration in the European Single Procurement Document. For years, administrative practice allowed a certain degree of flexibility regarding this requirement where the reliance concerned entities within the same corporate group, based on the controversial notion of a “single corporate will”.

This paper examines the doctrinal evolution of the procurement review bodies, which has led to the outright rejection of this thesis since Resolution 992/2024 of the TACRC and its subsequent adoption by regional bodies, with particular focus on Resolution 654/2025 of the TARCJA, which is of special interest in the Andalusian regional context, as it explicitly consolidates, for the first time, a restrictive interpretation of reliance on intragroup capacity. Lastly, it also addresses the recent Judgment C-812/24 of the Court of Justice of the European Union, of January 22, 2026, which clarifies the interpretation of Article 63 of Directive 2014/24/EU concerning reliance on intragroup capacity.

The study highlights the practical consequences of this interpretation for economic operators and contracting authorities, arguing that strengthening the structural nature of the ESPD does not constitute excessive formalism, but rather an essential guarantee of fair competition in public procurement.
