Declaration of the Spanish Constitutional Court on compatibility of the Spanish Constitution with the European Constitution

Abstract

We reproduce here the insteresting Declaration of the Spanish Constitutional Court in relation to the existence or non-existence of contradiction between the Spanish Constitution and certain articles of the European Constitution included in the Treaty already submitted to a referendum. The declaration includes three reserved votes. In other European countries, the Doctrine is expanding the area of study between possible contradictions between their Constitutions and the European Text
