Abstract

The recent approval by the Andalusian Parliament of the Law on Measures for Protected Housing and Land has reopened the debate about the limits and the virtuality of protection that the Constitution provides at the local level of government. It should not surprise, however, the extent and intensity of the controversy generated by that Law, whenever - and we adhere, obiously, to reasons of legal nature- it contemplates one of the most serious cases of interference in the sphere of local autonomy, namely the withdrawal of municipal authority in a material field considered essential and defining the action of the local level of government: the urban planning.
