The demarcation of the droveways and its judicial control

Abstract

The subject of this study is the analysis of the controversial demarcation of livestock routes and, I say controversial because both at the doctrinal level, and the practical reality of our Autonomous Community and throughout Spain is being the focus of not a few contentious. Certainly since the Law of the State in 1995 attributed the ownership dominion of the droveways  to the Autonomous Communities, all of them and, for us especially Andalusia, have launched a campaign of processing of demarcation files that are eternalized in time creating a serious situation of legal uncertainty- to which only the institution of expiration can give certainty and security -, and that, like a meteorite burst in the middle of agricultural exploitations, hunting, golf courses, even urban buildings... configured and consolidated with the passage of the years of disuse of the droveways.
