Abstract

The foundations created by universities are a widespread phenomenon in the territorial scope of Andalusia, where all public universities have at least one foundation that acts as an instrumental entity.

This article analyzes two aspects related to the legal regime for contracting on the university foundations: the level of subjection of such entities to Law 30/2007, on Public Sector Contracts, and the instrumental relations with their university, subject of special importance and that is conditioned to the fulfillment of limits and requirements established in the law and that have been object of a neat interpretation in the European jurisprudence.
