The public services Cooperative in Andalusia as a local mixed economy form of society

This paper studies the Andalusian cooperative company of public services, which is a semi-private company that could be used for the indirect management of public services. The scope of the paper is the Andalusian local governments. These cooperatives are mainly ruled by Private Law, but there are some aspects where Public Law must be observed. Therefore, the paper studies the impact of the public contract legislation on the formation of the company and how to deal with the principle of “open doors”. It also deals with the specialties of the social capital as well as the the decision-making process and the need of a public control on the implementation of the public service.
