The autonomous "improvements" in the regulation of right of access to public information

Abstract

After the publication of a New Transparency and Access to Information Law in the Spanish official gazette in December 2013, regional governments are now immersed in its legislative development.
In this paper we present the study of legislative initiatives subsequent to the publication of the state law. Some of these initiatives have been already passed (Andalusia, La Rioja, Region of Murcia, Catalonia, the Canary Islands and Castilla y León) or are still in the process of being approved -at a different pacein various autonomous regions (Basque Country, Aragón, Comunidad valenciana, Castilla-La Mancha and the Principality of Asturias).
The initiatives presented in this paper aim at highlighting aspects that were not yet dealt with in the state law but are intended to be regulated regionally. We will also draw attention to those strategies that involve “improvements” like shortening of deadlines, paperwork simplification or greater guarantees.
