The new destination of the municipal heritage land

Abstract

The municipal heritage land is a way to take part in the land market and avoid speculative policies. This is a classic technique in our urban law. It is true that the legal architecture has been conformed to urban and economic realities of the moment, but it seems that the possibility of reducing the commercial and financial debt of municipalities distorts what are their distinctive features and objectives. This new destination of municipal heritage land have been brought in the Ley de Suelo de 2008. In recent times, the municipalities have abused the municipal heritage land, being used for purposes not intended by the lawgiver and as a funding source of many different municipal needs. That´s why the object of this paper is to analyze whether this legal modification involves a temporary legal reform of its origin, characterization and purpose, or, on the contrary, we are attending the demise of the municipal heritage land.
