Abstract

In this work is studied the legal problem of the existence of thousands of illegal buildings on rural land in Andalusía. When the administration lose the term to observe the integrity of urban planning inevitably raises the question of the situation of this ilegal buildings when there isn´t any possibility of reintegration of urban order transgrated. In this context, the Andalusian Decree 2/2012, of 10 January, is to clarify the legal regime applicable to the various situations of this buildings on rural land, establishing the essential requirements for recognition and treatment in urban planning. In this regard, this work is centred in a figure called “assimilated to out of legal order”.
